Latest News Today – Twitter Gets ‘One Last Notice’ from Government to Comply

Citing non-compliance of New Intermediary Guideline Rules by Twitter, the Union Ministry of Electronics and Information Technology (MeitY) on Saturday sent a final communication to Twitter asking them to comply immediately with the requirements of the new guidelines failing which resultant consequences as enjoined in the law shall follow.

A letter issued by the Ministry to the social media platform stated that the New Intermediary Guideline Rules have become effective from May 26. After expiry of three-month period given to social media intermediaries for compliance, Twitter is yet to appoint India based Chief Compliance Officer, Nodal Contact Person, and Grievance Officer.

“The provisions for significant social media intermediaries under the Rules have already come into force on May 26 2021 and it has been more than a week but Twitter has refused to comply with the provisions of these Rules. Needless to state, such noncompliance will lead to unintended consequences including Twitter losing exemption from liability as intermediary available under section 79 of the Information Technology (IT) Act, 2000. This has clearly been provided under rule 7 of the aforesaid Rules,” stated the letter.

It further said, “This is with reference to this Ministry’s letters dated May 26 2021 and May 28 2021 regarding compliance with the subject Rules and your corresponding responses dated May 28 2021 and June 2 2021. MeitY is dismayed to note that your responses to the Ministry’s letters neither address the clarifications sought by this Ministry nor indicate full compliance with the Rules.”

It also stated that it is clear from the responses of Twitter that till date has not informed about the details of the Chief Compliance Officer as required under the Rules, added that the Resident Grievance Officer and Nodal Contact Person nominated by the social media platform is not an employee of Twitter Inc. in India as prescribed in the Rules.

It also said that the office address of Twitter as mentioned by it is that of a law firm in India, which is also not as per the Rules.

The Ministry in its letter to Twitter stated that the refusal to comply demonstrates the social media platform’s lack of commitment and efforts towards providing a safe experience for the people of India on its platform.

The world’s largest democracy has been among the first countries in the world, outside the parent country of Twitter Inc., to enthusiastically adopt the Twitter platform, said the Ministry, adding that despite being operational in India for more than a decade, it is beyond belief that Twitter Inc. has doggedly refused to create mechanisms that will enable the people of India to resolve their issues on the platform in a timely and transparent manner and through fair processes, by India based, clearly identified resources.

Leave alone proactively creating such a mechanism, Twitter Inc. is in the inglorious bracket of refusing to do so even when mandated by law, it added.

The ministry further stated that the people of India, who use the Twitter platform, deserve and demand a fair mechanism to address their grievances and resolve their disputes. Users who are abused on the platform or are harassed or are subject to defamation or sexual abuse or become victims or a whole range of other abusive content must get a redressal mechanism that the same people of India have created through a due process of law, it said.

“Though with effect from May 26 2021, in view of Twitter Inc’s non-compliance with the Rules as noted above, consequences follow. However, as gesture of goodwill, Twitter Inc. is hereby given one last notice to immediately comply with the Rules, failing which the exemption from liability available under section 79 of the IT Act, 2000 shall stand withdrawn and Twitter shall be liable for consequences as per the IT Act and other penal laws of India,” the ministry’s letter to Twitter concluded.

This comes amid withdrawal of verified blue badge by Twitter from the verified accounts of Vice President of India M. Venkaiah Naidu, RSS chief Mohan Bhagwat and several Sangh functionaries.

Twitter had removed the blue badge from the personal Twitter handle of Vice President of India M. Venkaiah Naidu, @MVenkaiahNaidu. Although, the official handle of the Vice President of India @VPSecretariat continues to have the blue badge. Later today, issuing clarification that since the account was inactive since July 2020, as per Twitter verification policy, the social media platform may remove the blue verified badge and verified status if the account becomes inactive or is incomplete, the badge was restored.

Twitter will appoint a local representative in Turkey under a contentious social media law that allows authorities to remove content from platforms, a government official said on Friday.

Turkey’s new social media regulations entered into force in October after being passed in parliament by President Recep Tayyip Erdogan’s ruling party.

They require platforms with more than one million unique daily users to appoint representatives who can handle court orders to take down offending content within 48 hours.

Non-compliance could lead to fines or restrictions on bandwidth, blocking access to the platforms.

In January, Turkey hit Twitter, Pinterest, and Periscope with advertising bans after they failed to appoint a local envoy to take down contentious posts under the law.

Facebook has appointed a representative to comply with the Turkish law.

Turkey’s deputy minister for infrastructure Omer Fatih Sayan said on Friday that Twitter would follow the suit, the Anadolu state news agency reported.

Rights advocates see the new regulations as part of the government’s attempt to control social media and clamp down on dissent.

Centre’s Message To Twitter On Blocking Accounts: Comply | Sidnaz Blog

The government said that Twitter gave “differential treatment” to India and the US.

The government on Wednesday expressed “strong displeasure” about Twitter’s response to the emergency order to block more than a thousand accounts for alleged spread of provocative content and misinformation on the farmer protests. As a business entity working in India, Twitter “must respect” the Indian laws and follow them “irrespective of Twitter’s own rules and guidelines”, the government said, making it clear that Twitter should block the accounts immediately.

“Lawfully passed orders are binding on any business entity. They must be obeyed immediately. If they are executed days later, it becomes meaningless,” the ministry said.

Citing its crackdown on accounts after last month’s violence at Washington’s Capitol Hill, the government also told Twitter that the “differential treatment” it provided to India and the US is “deeply disappointing”.

The meeting between Electronics and IT ministry and the Twitter representatives — Monique Meche, Vice President Global Public Policy and Jim Baker, Deputy General Counsel and Vice President Legal — took place after the social media platform snubbed the government over its request to block 1,178 accounts.

In its response, Twitter had said the government’s orders were inconsistent with Indian law. The microblogging platform also said it would restrict access within India for some accounts instead of an outright ban.

Twitter has suspended over 500 accounts, and blocked access to several others within India while refusing to block accounts of “news media entities, journalists, activists and politicians” citing the need to uphold freedom of expression.


In a communique late in the evening, the IT ministry said Twitter was told that under the Indian constitution, freedom of speech is not absolute but is subject to certain restrictions as mentioned in Article 19 (2) of the Constitution of India.

Pointing out that various judgments of the Supreme Court have also upheld this from time to time, the government said, “Twitter is welcome to do business in India – Twitter, as a business entity working in India, must also respect the Indian laws and democratic institutions. Twitter is free to formulate its own rules and guidelines, like any other business entity does, but Indian laws which are enacted by the Parliament of India must be followed irrespective of Twitter’s own rules and guidelines”.

The government also expressed deep disappointment to the Twitter leadership about the manner in which the platform has “unwillingly, grudgingly and with great delay complied with the substantial parts of the Twitter was reminded about the action it took after the Capitol Hill episode in the US and compared that with the disturbance in Red Fort in India and its aftermath.

The ministry secretary “expressed dissatisfaction over Twitter’s differential treatment in the two incidents,” the government said.

“A deep sense of disappointment at seeing Twitter side not with ‘freedom of expression’ but rather with those who seek to abuse such freedom and provoke disturbance to public order, was conveyed to the Twitter representative,” the communique read.
